Responsible for the processing of personal data
Derived from its activities, ONIX LIVING collects and has access to the personal data that are indicated below and that are owned by individuals (hereinafter, the "Personal Data").
In accordance with the Law for the Protection of Personal Data in Possession of Private Parties (the "Personal Data Law"), the following shall be understood as Processing of Personal Data: The collection, use, disclosure or storage by any means. Use includes any action of access, handling, use, exploitation, transfer or disposal of personal data.
ONIX LIVING is committed to protect your data under the terms of the Personal Data Law and this Notice and, therefore, not to transfer them to any third party, without the prior consent of the owner, except for the particularities and exceptions indicated in the Data Law and this Notice.
For the purposes of the preceding paragraph, ONIX LIVING's personnel, employees, shareholders, directors, managers, attorneys-in-fact, real estate consultants and other representatives of ONIX LIVING of any kind shall not be considered as third parties.
Collection of personal data
For the collection of personal data, we follow all the principles established by law, such as legality, quality, consent, information, purpose, loyalty and responsibility.Personal data will be collected directly from the holder in person or through other sound, visual or any other legally permitted technology, either through applications, forms, interviews, socioeconomic studies, evaluations, on our website or online services, digital platforms, among others.
We also inform you that our website www.onixliving.mx may use cookies to enhance the user experience. The user's web browser places cookies on their hard drive for record-keeping purposes and sometimes to track information about them. You can choose to set your browser to refuse cookies or to alert you when cookies are being sent. Please note that some parts of the site may not function properly when this option is disabled.
Personal Data that the holder may provide directly to ONIX LIVINGshall be, among others, the following:

Legal entities

- Bylaws of the company and powers of representation

Source of resources
Likewise, when the holder makes a payment to ONIX LIVING, the necessary banking information will be collected to comply with the Federal Law for the Prevention and Identification of Operations with Illicit Proceeds, such as: (i) complete source account number, (ii) CLABE, (iii) headline, (iii) banking institution.
Purposes of the processing of personal data
In compliance with Section II of Article 16 of the Personal Data Law, ONIX LIVING hereby informs the holder that the purpose for which it will process his Personal Data will be mainly related to the marketing, promotion and sale of real estate, in accordance with the following:
- Identify you as a customer
- Integration of your file.
- Follow up on requests for information
- Sending documents and quotations
- Preparation of invoices and receipts
- Preparation of contracts, agreements and/or any legal document related to the acquisition of real estate.
- To comply with the obligations regarding money laundering prevention.
- After-sales follow-up
In addition, ONIX LIVING may use the Personal Data of the holder for the following secondary purposes, which will allow ONIX LIVING to improve its services and, in particular, to provide better customer service: (i) Requesting the owner's evaluation and feedback on the service provided by ONIX LIVING; and (ii) Send promotions and advertising of new products and services that may be of interest to you.
The refusal by the owner for ONIX LIVING to process his Personal Data for the secondary purposes mentioned above must be communicated to ONIX LIVING to the contact details provided in this Privacy Notice and this may not be a reason for ONIX LIVING to refuse to enter into the transaction.
Means to limit the use or disclosure of personal data
In accordance with article 16, section III of the Personal Data Law, and articles 19, 20 and 21 of said law, ONIX LIVING, has established security, administrative, technical and physical measures to protect the Personal Data of the holder against damage, loss, alteration, destruction, or against the use, access or unauthorized processing, which are not, in any way, less than those that ONIX LIVING has implemented for the processing of its own information.
ARCO Rights
In compliance with the Personal Data Law, ONIX LIVING informs the holder that, with respect to the processing of their Personal Data, the holder has the rights set forth below, known as ARCO rights:
- Access: The right to know what personal data we have in our records and database as well as the purpose for which ONIX LIVING keeps them.
- Rectification: The right to rectify your personal data when it is inaccurate or incomplete.
- Cancellation: The right to request ONIX LIVING to remove personal data from its records or databases when the owner considers that they are not being used properly, in accordance with the Personal Data Law and this Notice.
- Opposition: The right, for legitimate reasons, to oppose the processing of your data, with the exception of the provisions of Article 26 of the Personal Data Law.
In order to exercise any of the ARCO rights, the holder must prepare a written request that must contain, among other things, the following:
- The name of the owner, address and e-mail address to communicate the response to your request.
- Documents proving the identity or, as the case may be, the legal representation of the holder
- The clear and precise description of the Personal Data with respect to which the exercise of any of the ARCO rights is sought.
- Any other element or document that facilitates the location of the Personal Data.

Once the request is received by ONIX LIVING, it will respond to it within a period not exceeding 20 (twenty) business days to the email that has been provided by the owner.
Transfers of personal data pre-approved by the holder
ONIX LIVING may, without prior authorization of the holder, share with the third parties indicated below, for the purposes indicated therein, the Personal Data of the holder:

ONIX LIVING reserves the right to modify this Privacy Notice at any time. Modifications will be available in any of the following media: (i) visible advertisements in our offices; (ii) on our website; or (iii) sending to the e-mail address provided by the owner of the personal data.
Consent
The signature of this Privacy Notice by the holder, or the failure to expressly object to its contents within 15 calendar days of its knowledge, implies the full and unreserved consent of the holder, for the processing of their Personal Data in accordance with this Privacy Notice.
